(Lafayette Hill, Pennsylvania – 10/21/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that Obama and tbe DNC “ADMITTED”, by way of failure to timely respond to Requests for Admissions, all of the numerous specific requests in the Federal lawsuit. Obama is “NOT QUALIFIED” to be President and therefore Obama must immediately withdraw his candidacy for President and the DNC shall substitute a qualified candidate. The case is Berg v. Obama, No. 08-cv-04083.

Berg stated that he filed Requests for Admissions on September 15, 2008 with a response by way of answer or objection had to be served within thirty [30] days. No response to the Requests for Admissions was served by way of response or objection. Thus, all of the Admissions directed to Obama and the DNC are deemed “ADMITTED.” Therefore, Obama must immediately withdraw his candidacy for President.

Dave comment: The only emotions that I control are my own. The rest of your comment is factual. I would guess (and it's) only a guess, that Barrack might find some reason for a secondary agenda to become his primary agenda while in Hawaii.

Also I try to make it a point to source material....which does indicates that I am thoughtful, which by common understanding is nice.

It is the practice of attorney's to prepare the actual order for the court BEFORE the court agrees or not. However folks, a motion for summary judgement is a big deal. Obama had 30 days to respond and didn't. This constitutes an admission. Clearly Obama is trying to drag this out past the election and then, if booted, the dems claim foul play.

If the court follows proper procedure, Obama is dead in the water. It curious this was filed in Pennsyvania, the same place all those bible thumping - gun toting bigots live. Highly appropriate.

Obama, as a lawyer, should know better than to ignore court process. However, I'm also certain he has a team of slicksters telling him what he can get away with. This isn't over yet.
The DNC already has Biden positioned. If the election goes forward with Obama, it now becomes and issue of whether Biden 'should' step up. In that case, instead of having an america hating communist we end up with an idiot communist. The real issue will be whether or not the court will validate the Obama fraud on any level. The rub comes in the fact that Biden will have actually been elected. I'd say it qualifies as a real constitutional crisis.

On the otherhand, if McCain/Palin prevail the issues become moot.

The issue now is how the court will come down and when.

I have taken note that all of a sudden, today the media brought up the "Who? What? When?" regarding the financial crisis for the umpteenth time and are pushing it harder now than before. I have a suspicion that this may be the reason why. If this gets out, they'll be basted and barbequed like the pigs they are.

Cal, I do understand the common practice of filing a prepared order for the judge to sign, if the judge rules in favor of the motion. But I disagree that the motion for a summary judgment is necessarily significant. That, too, is commonly done. And all too commonly denied. Just "boilerplate" court proceedings.

What is most significant to me is that Obama's shysters have allowed this devolve to a default judgement. Given how many other legal challenges (others against Obama, as well as ones against McCain) have been summarily dismissed for various reasons (like lack of standing of the plaintiff, etc.), it seems a virtual admission on the part of Obama and the DNC to not even file some pleading for delay so a summary judgment wouldn't automatically be in order.

And, Dave, you misled with the subject of this thread. Nobody has admitted any allegations. That's just Berg's press release hype. Of course you only control your own emotions. My quip, though, was about your tantalizing but untrue subject line which I allowed to raise my hopes on. A disclaimer should have been in the lead in of your posting.

But, yeah, you are "nice" for providing links. It's just real hard to track down something that doesn't exist. Like an actual judge's ruling on this. So, you get 1/2 an "exalt" and 1/2 a "smite" for leaving that part out.

Parn, the last I saw on the matter in the "real" media, only the Herald Tribune had reported on this. And that, likely only because Berg is a local "personality". Still nobody else seems to want to touch this. As a blog reported (which I think was noted in this forum), Fox News wouldn't even touch the story unless it was "reported in other media". Something flat out stinks about that.

Especially because this suit wasn't summarily dismissed like others of its kind.

The summary judgement motion has solid grounds BECAUSE OF THE DEFAULT.

I also agree - this is beyond stupid but we have to wait and see what Obama's sharks have up their sleaves.

About the only thing that I can think of that makes any sense is that they have an appellate court judge in their pocket who, unlike Surrick, is ready to roll over and dismiss.

So, they'd let the default judgement occur and move it on up.

Interesting how Hillary could fit into all this.

Here are three possibilities:

If there is a judgment against Obama before the election could the election get called off until Hillary gets a judgment in a suit she would likely file against Obama for ruining her chance at the nomination?

If there is a judgment against Obama after winning the election and before inauguration will Hillary sue Biden for the Presidency?

If there is a judgment against Obama after McCain wins will Hillary have a suit against McCain?

If the case is thrown out can or will it be raised again by Hillary?
